Terms of Service for Milan Kiele

These are the terms for the various services, including Branding, logo design, Websites, Hosting, etc., provided by Milan Kiele and access to the website: https://milankiele.com. For any potential issues, please communicate them before starting each project to find a feasible solution.

Delivery and Payment Methods

I reserve the right to request a 60% deposit as an advance before starting the project, except for digital services (Hosting, corporate emails, social media, etc.). An invoice for the total amount can be issued at the end of the project, which will be delivered via email. By accepting these Terms of Service, You enter into a contract with Milan Kiele.

The remaining project cost and associated services will be invoiced before the publication of any project files or final services. I reserve the right to withhold delivery until full payment has been received.

I reserve the right to issue an invoice if You have been uncontactable or unresponsive for more than 15 days. You may request a payment plan, which may be accepted at my discretion. All payment plans must be agreed upon by both parties.

I reserve the right to charge fees related to the collection and recovery processes for accounts that remain unpaid for more than 30 days.

Conditions

These Terms of Service do not grant You the rights to use, modify, or duplicate any ideas, sketches, projects, or services provided. All original preparatory materials and unused ideas remain the property of Milan Kiele, as well as digital services in general. I am free to use unused ideas for future work. If unused material resembles the finished work, I will modify it to ensure the final project is sufficiently distinct.

I reserve the right to display the completed work in my portfolio and in any printed media, social media, or other publication or dissemination medium. Any elements or supporting materials required for projects may be used by Milan Kiele or partners for personal and professional reasons. You are free to change, modify, and adapt the design of the completed project as You see fit, at Your own risk; this does not apply to digital services.

Copyright

If the final payment is NOT received as agreed, all designs and concepts remain the property of Milan Kiele until payment is received. If the final payment is not obtained, I reserve the right to reuse or modify any material for other clients, use it in my portfolio, and general dissemination media.

If You attempt to use or appropriate the work, in whole or in part, without making the agreed final payment, legal action will be pursued. If You have specific confidentiality requirements, these must be mentioned before accepting the proposal. The final payment ensures that only the agreed work becomes Your property. Any ideas, original materials, prior concepts, or digital services remain the property of Milan Kiele, unless otherwise agreed in advance.

Cancellation

If You decide to cancel the project or contracted service midway after ideas and proposals have been presented, the advance payment is non-refundable. However, a portion of the funds may be refunded based on the progress made.

If the project cannot be completed due to unforeseen circumstances, a portion of the total budget will be refunded. I reserve the right to suspend any project if there is negativity or lack of trust from the client to proceed, if multiple proposals and ideas have been presented, or if there is refusal to make the final payment. Any suspension or termination does not entitle You to refunds, and all developed materials remain the property of Milan Kiele.

In case of non-compliance due to disasters or acts of any nature beyond my control, it will not be considered a breach of these Terms of Service, and performance may resume after the conclusion of the disaster or third-party acts.

Liability

You agree that Milan Kiele is not legally responsible for any loss or damage related to the use of any services, whether due to errors or omissions in documents, projects, or any services offered by Milan Kiele. This includes the use in any content.

Your use of any material is entirely at Your own risk. You acknowledge that such information, materials, and services may contain variations or errors, and Milan Kiele is expressly excluded from liability.

All submitted projects will be original. Limited checks are performed to ensure the project does not infringe on any existing similar work. However, I assume no legal responsibility for any material or service regarding legal issues. You may conduct Your own checks regarding plagiarism and originality.

Brand Ownership

You assume full responsibility for ensuring that Your company, product, or brand name is legally available before work begins. If any legal issues arise after the project is completed, no refunds will be made, and I am not legally responsible for any issues in general.

Ensure that the name You are using is free and legally safe before starting a project. Changing the name of a project during development is costly and causes significant delays, resulting in a new full charge as a new project. Ensure the name is not used by another person or registered trademark.
